Make an Export Compliance Plan, Avoid Federal Penalties, Grow Your Business

Welcome to Global Trade Attorneys, your trusted partner in navigating Export Enforcement. Many federal agencies are tasked with protecting and promoting U.S. national security by aggressively investigating violations of export controls with international trade. These agencies include:

  • BIS - Bureau of Industry and Security
  • OEE - Office of Export Enforcement and its ECOs - Export Control Officers
  • CBP - Customs and Border Protection
  • DOJ, DOS, DOC, DOT - Departments of Justice, State, Commerce, and Treasury
  • And many more.

Understanding the governing export rules for your industry can help you avoid running afoul of them. Breaking the rules can trigger administrative and criminal penalties. Ignorance of the rules is not a defense. We help you understand your rights and obligations, plan for compliance, conduct due diligence, and challenge penalty actions.

With all of these rules and regulations to follow, does it make sense for my small or mid-sized business to start exporting or expand to new markets? YES - and here’s why:

  1. More than 70% of the world’s purchasing power is OUTSIDE the U.S.
  2. 96% of the world’s consumers are outside of the U.S.
  3. Small exporting businesses outperform non-exporting businesses on a variety of performance measures (revenue, labor productivity, and growth).
  4. Companies that export tend to grow faster, pay higher wages, and be more resilient than firms focused solely on the domestic market. They are diversified, agile, and able to survive economic & supply chain challenges.
  5. Investing in exports means more LOCAL jobs, with 1 in 5 U.S. jobs related to trade.
  6. You are in good company:

              a. 97% of businesses that export are classified as small.

              b. 2.6 million small businesses have the potential to become exporters (known as the total

              addressable market).

              c. There is strong support at federal, state, and local levels, to reduce impediments to trade.

Next, we'll look at what steps you can take toward this plan.

Pillars of Success - Part 3 - Deemed Exports

In this final installment covering the 3 things exporters must get right to avoid getting into hot water with the U.S. agencies governing trade, Jennifer Tipping goes into detail about the impact of deemed exports on trade. Avoid the accidental exchange of information about your products or services. We'll follow dog toy inventor Daisy and her toy that has gone viral and global: Daisyz Dog Toyz.
